1. Object

1.1. These Terms and Conditions of Sale (hereinafter, “Terms and Conditions”) serve the purpose of regulating the purchase of Products, ordered remotely through computer network, from the www.kalentin.co.uk website (hereinafter, “the Website”).
1.2. The Website owner is Kalentin Italia UK Ltd with registered office in 164 Boudary Road WA10 2LS St. Helens, Vat no. 190437113.

2. Acceptance of the terms and conditions of sale

2.1. All purchases of Products made through the Website (hereinafter, “the Purchase Contracts”) by the users that access it (hereinafter, “the Customers”) are regulated by these Terms and Conditions, as well as by the Distance Contracts section II (articles 50 - 67) of the Italian Consumer Code (legislative decree no. 206/2005), and by the Italian rules regarding electronic commerce (legislative decree no. 70/2003).

2.2. With the conclusion of the Purchase Contracts and according to the procedure, the Customer accepts and undertakes to observe these Terms and Conditions.

2.3. The Customer is therefore obliged to carefully read these Terms and Conditions made available by Kalentin E-Commerce before making any purchase transaction. They are also allowed to be reproduced and stored in accordance with the rules of art. 12, paragraph 3, of Legislative Decree no. 70/2003.

2.4. Kalentin E-Commerce may amend the content of the Terms and Conditions at any time without prior notice. Each individual Purchase Contract will be governed by the Terms and Conditions published on the Website at the time that the purchase order is submitted by the Customer.

3. Products

3.1. www.kalentin.co.uk (hereinafter “the Website”) is an online website for the sale of cosmetics, beauty products for body care, nail, make-up and general related accessories with the exclusive Kalentin brand (hereinafter, “Products”).

3.2. All the Products available are illustrated in detail on the Website, within their respective sections, with distinct Product categories.

3.3. The visual representation of the Products on the Website, where available, is indicative and usually corresponds to the photographic image of the Products, having the sole purpose of presenting them for sale, without any guarantee or commitment on the part of Kalentin Italia UK regarding the exact correspondence of the image depicted on the Website to the actual Product, in particular to the actual size and / or colour of the Products and / or packaging.

3.4. Where there is a difference between the image and the written Product page, the description on the product page is always reliable.

4. Buying process

4.1. The Customer can buy the Products in the Kalentin online catalogue, described in detail in their respective sections on the Website by product category, as well as described in the relevant information sheets contained in the Website, respecting the technical access procedures described in Buying Guide.

5. Concluding the Contract

5.1. The publication of the Products displayed on the Website constitutes an invitation to the customer to make a purchase contract proposal. The order placed by the Customer is seen as a proposal of contract and involves the full knowledge and acceptance of these Terms and Conditions.

5.2. Each Purchase Contract entered into between Kalentin and the Customer must be concluded by Kalentin sending the order acceptance to the email address of the Customer.

5.3. Each order can be viewed by the Customer in their own personal area of the Website if they are registered, or by contacting the Kalentin Customer Service department immediately after the order has been placed ( phone 0151 3456762).

5.4. In the event of occasional unavailability of the Products offered, where the Products chosen by the Customer are not in whole or in part available, the order will be sent with the Products that are available after notice has been sent to the Customer regarding the Products that are not available.

5.5. Kalentin has the right to choose at its discretion whether or not to accept the order placed by the Customer and the latter has no rights or claims of any kind, or title compensation, where the order itself is not accepted.

6. Product prices

All product prices are clearly indicated on the Website and are inclusive of VAT. Delivery costs are adequately highlighted at the time of the order. The cost of each shipment may vary depending on the delivery and payment methods as well as the destination and the total amount of the order.

7. Shipping methods and costs

7.1. Kalentin is committed to delivering the goods without undue delay and therefore no later than thirty days after the contract is concluded. The delivery of the Products will be carried out by courier, and the delivery times will vary depending on the destination. The terms specified at the time of the purchase order serve as an indication.

7.2. Kalentin E-Commerce delivers to all the countries listed on the Website and delivery will take place without an appointment.

7.3. No responsibility of any kind can be transferred by the Customer to Kalentin E-Commerce in the event of a delay either in the fulfillment of the order or the delivery of the Products in the purchase contracts.

7.4. The Products ordered will be sent to the postal address specified by the Customer. When the Products are assigned by Kalentin E-Commerce to the designated courier, an email will be sent to the Customer with shipping confirmation.

7.5. Deliveries will be carried out from Monday to Friday, during normal business hours excluding bank holidays, according to the procedures indicated by the courier chosen by the Customer. Delivery is deemed to be completed at the time that the Product is made available to the Customer at the address specified on the order form. In the case of non-delivery due to the recipient being absent at the given address, the courier will send an email alert and attempt a new delivery according to the existing procedures.
If it is impossible to carry out the new delivery due to the recipient being absent, the Customer Service department will attempt to contact the Customer to schedule a further delivery. If the Customer Service department does not manage to contact the Customer over the next 10 days, or if delivery is again not possible due to the recipient being absent, the Products in the order will be returned to Kalentin E-Commerce.
30 (thirty) days after the date when the Products in the order were returned to Kalentin E-Commerce due to delivery not being possible, the contract will be terminated and the purchase order will be canceled in accordance with Article 1456 of the Italian Civil Code. K Lashes E-Commerce will then refund the sum paid by the Customer excluding the cost of returning the Products and the cost of storing them at the branch of the courier in charge of delivery.

7.6. The termination of the contract and the refund amount will be communicated via email. The refund amount will be credited to the payment method used by the Customer for the purchase. In the case where, before the thirty days have expired, the Customer requests again to receive the Products purchased, Kalentin UK E-Commerce will proceed to deliver again subject to a charge, in addition to the delivery cost, to cover the costs of returning the Products to Kalentin E-Commerce and the storage costs.

7.7. At the time of delivery of the Products by the courier designated by Kalentin E-Commerce, the Customer is required to check carefully:
a) That the tamper-proof label is intact and the packaging is not damaged or tampered with;
b) That the number of packages delivered corresponds to the number detailed in the shipping documents.

7.8. Any damage to the tamper-proof label, to the packaging or to the Products or any discrepancy in the number of items/packages or in the instructions must be immediately reported by the Customer, who can contact Kalentin E-Commerce through the Customer Service department, specifying the order where mistakes have occurred.

7.9. Force majeure events, unavailability of transportation methods, as well as unforeseen or unavoidable events that cause a delivery delay or that make deliveries difficult or impossible or cause a significant increase in the delivery cost charged to Kalentin E-Commerce, give the company the right to divide, postpone or cancel, in whole or in part, the planned delivery or to terminate the Purchase Contract. In such cases it is up to Kalentin E-Commerce to provide timely and adequate notice of its intention to the email address specified by the Customer, who will be entitled to a refund of any money already paid, excluding any further claims, of any kind, against Kalentin E-Commerce.

8. Non-conformity of the Products and defective Products

8.1. The Products offered on the Website are in compliance with national and EU legislation. The images and colours of the Products published on the Website may differ from the actual ones due to local settings of systems and/or tools used for their display.

8.2. In the case of a lack of conformity of the Products purchased in relation to their description published on the Website and in the event of a faulty or defective Product, the Customer is entitled to an immediate refund for the non-conforming goods. They must first send photographic evidence of the damage or non-conformity of the Product via email to info@kalentin.co.uk. The Customer must notify Kaletin of faulty products or wrong items within 10 days from receiving the parcel in order to be entitled to a refund.

8.3. This will be followed by communication from the staff at Kalentin which will indicate the refund method to be expected which, at the discretion of the Customer, could also be through discount vouchers for their next purchase greater than the value of the goods to be refunded, excluding Kalentin Italia UK from further responsibility of any kind.

9. Return Policy

9.1. In case of non-conformity of the products and defective product, please refer to section 8.

9.2. We offer a "cooling-off period" of 14 days to return the ordered products if you have changed your mind and wish to cancel. The goods must be returned unused, unopened, and in the same condition as they were originally dispatched from Kalentin. The client is responsible for the delivery fee to return the items to Kalentin. The refund will be issued after the items have been received by Kalentin and they have been inspected. The refund will not include the original delivery charge, and a 3% transaction fee will be deducted from the refund. Items that have been used or not in the exact condition in which they were dispatched by Kalentin, even if the products were sent in error, will not be accepted for exchange or refund.

10. Processing of personal data

Customer data is processed by Kalentin Italia UK in accordance with the legislation in force concerning the protection of personal data, as specified in the information present in the dedicated section entitled “Privacy Policy”.

11. Communications and complaints

All Customer communications or any complaints against Kalentin relating to Purchase Contracts must be communicated through the appropriate contact form which can be found in the Reserved Area.

12. Intellectual property rights

All trademarks (registered or otherwise) as well as any intellectual property, distinguishing mark or name, image, photograph, written text or graphic and, more generally, any other intangible asset, protected by international copyright laws and conventions on intellectual and industrial property rights, which is reproduced on the Website will remain the exclusive property of Kalentin and/or its licensors, and the Customer does not derive any rights to these through their accessing the Website and/or concluding Purchase Contracts. Any use thereof, even if only in part, is prohibited without the prior written authorization of Kalentin, which exclusively reserves all relative rights.

13. Applicable Law and Jurisdiction

13.1. These Terms and Conditions and any contract entered into with the Customer are governed by Italian law, subject to the application of EU legislation and international treaties, where applicable, as well as of the national legislation for consumer protection.

13.2. For any dispute concerning the interpretation, execution, validity or effectiveness of these Terms and Conditions and of any contract with the Customer, the Court of Milan will have exclusive jurisdiction.
